License and Sales Agreement
By typing your name in the box below and clicking the box labeled “I Agree” you affirm that you understand you are entering a binding contract with ChicagoPhotoShop.com and agree to abide by each and every of the following terms and conditions:
o You must submit all original photographs, images, art work, etc., (hereinafter referred to as “pieces”) that you wish to post for sale on ChicagoPhotoShop.com in digital form either via email to _______TBA___________ or on a c.d. by mailing to ChicagoPhotoShop.com at the following address: ____________TBA_________.
o You agree to give ChicagoPhotoShop.com a commission of 14% of the proceeds of all sales made of your pieces that are sold by ChicagoPhotoShop.com.
o Accompanying each piece you send, you will list the set price you choose for each piece, listing a separate price for sale in each of the following sizes: 5x7, 8x10, 11x14, and 16x20. ChicagoPhotoShop.com will honor your set prices and will not sell your work for any other price than that set by you.
o You will submit no more than 150 pieces total to ChicagoPhotoShop.com at one time. You may have up to 3 categories of work (such as …. How do you want to define this?) and a maximum of 50 pieces per category.
o You will NOT submit any photographs, images, paintings, etc. that depict people in any capacity whatsoever, whether the people are real or fictitious.
o You firmly state and assert that all pieces submitted for sale by you are owned exclusively by you, that no other person may make any claim of right of ownership to pieces submitted by you, including but not limited to: copyright, patents, trademarks, any claim that a piece was created by another person or co-created by another individual. You further agree to hold ChicagoPhotoShop.com harmless and indemnify ChicagoPhotoShop.com should any lawsuit arise over the ownership of any pieces submitted by you.
o By submitting your pieces to ChicagoPhotoShop.com you are granting ChicagoPhotoShop.com a license to sell each piece and retain a commission of 14% of each sale. You retain sole ownership and proprietary rights in each piece and are not granting ChicagPhotoShop.com any ownership rights by submitting your pieces for sale.
o ChicagoPhotoShop.com will retain any and all profits from the sale of framing of your pieces and selling such pieces with a frame and/or matte or other additional materials. Should you have any specific framing or matte with a specific piece, please contact ChicagoPhotoShop.com to discuss this further. Without such contact all pieces are assumed to have no specific framing or mattes and such will follow the above condition wherein ChicagoPhotoShop.com will provide these and retain any profits therefrom.
o ChicagoPhotoShop.com reserves the right to remove or refrain from posting any pieces for any reason whatsoever without providing any explanation for the failure to post such piece or the removal thereof.
o You understand that the payment for each piece sold will come directly to ChicagoPhotoShop.com and then the payment will be forward to you by ChicagoPhotoShop.com after deducting the 14% commission.
o ChicagoPhotoShop.com provides no guarantees for the length of time or duration such pieces will remain posted for sale and further, reserves the right to change or alter the terms and conditions of this site with proper notice to you of such change.
o Each time you submit new pieces to ChicagoPhotoShop.com you must again e-sign these terms and conditions and click the box below indicating “I Agree” to such terms and conditions.
